Insect Nuisance
ListenThe Clean Neighbourhood & Environment Act 2005 has now widened the powers under the Environmental Protection Act 1990 to enable local authorities to investigate and if necessary to take statutory nuisance enforcement action for complaints related to insect nuisance. The insects must either be prejudicial to health or a nuisance, but there are exemptions for certain types of land, including arable land, ponds, lakes, reed beds, orchards and nurseries.
The legislation does not aim to hinder biodiversity but to prevent undue discomfort and annoyance from certain insects found in prolific numbers, for example mosquitoes, cockroaches, house flies and fruit flies in domestic homes, either through the act, default or sufferance of a commercial undertaking or from a nearby domestic premises.
The process to resolve these issues is to look at hygiene, husbandry and management of the source site in order to eradicate the continuation of the infestation.
