High Hedges
Neighbourly disputes over hedges are slowly becoming more commonplace, and the media has taken more of an interest since a couple of high profile cases brought the issue into the public eye.
The height of a hedge is often a cause of problems between neighbours, and so legislation has been introduced to allow Local Authorities to deal with such complaints.
Legislation
The legislation that has been brought in to deal with high hedges is the Anti Social Behaviour Act 2003.
Limitations
The legislation imposes certain requirements and limitations on the way high hedges are addressed:
- The complaint can only be about hedge height, no other matter.
- The hedge must impact the complainant by means of loss of light into their garden and/or home.
- The complainant must have attempted to resolve the situation before contacting the Council, and must have evidence of this.
- You can only complain if you are the one being affected by the presence of the hedge.
