3 Steps to Making a Complaint
Step 1: Identify Whether the Hedge is a Potential Nuisance.
- Is the hedge on another person's property?
- Is the hedge comprised wholly or predominantly of a line or more of evergreen or semi evergreen trees or shrubs?
- Is it over 2 metres high?
- Does the hedge act as a barrier to light?
- Does the light loss adversely affect your enjoyment of your home or garden?
Step 2: Communicating With Your Neighbour.
Before contacting the Council, you must have tried to contact your neighbour to discuss the situation first.
- Send a letter (keep copies of any letters sent and received)
- Try talking to them (keep a record of when you tried talking to them, and what was said)
- Mediation, where both parties talk through the issues involved, this will be through a third party such as a legal advisor
If you are nervous about contacting your neighbour, send them a letter, as it will not be enough to say that “they are not approachable”.
Step 3: Contacting the Council.
When you initially contact the Council please ensure you have:
- Evidence of communication e.g. letters or a diary of conversations; and
- Evidence of mediation; and
- Reasons why you believe the hedge is a nuisance and how it is affecting you
