Minerals and Waste Planning
ListenThe current Minerals Plan for Berkshire is the Replacement Minerals Local Plan (RMLP), altered and then adopted in May 2001. The plan aims to ensure that mineral extraction can take place at an appropriate rate throughout the period to the end of 2006, and that there are enough planning permissions in place at the end of that period to allow for a further seven years of extraction, (i.e. to the end of 2013).
The Waste Local Plan (WLP) for Berkshire was adopted in December 1998 following a public inquiry which took place in 1995/96. It covers the period up to 2006.
In September 2007 the Secretary of State directed that, under paragraph 1 (3) of Schedule 8 to the Planning and Compulsory Purchase Act 2004, a number of policies in the Minerals and the Waste Local Plans should be saved indefinitely until replaced by national, regional or Minerals and Waste LDF policies. Planning decisions must continue to be taken in accordance with the saved policies of these plans unless material considerations indicate otherwise.
Under the provisions of the Planning and Compulsory Purchase Order 2004, the six unitary authorities in Berkshire commenced preparation of a Joint Minerals and Waste Local Development Framework, to replace the Replacement Minerals Local Plan and the Waste Local Plan. Following the decision to close the Joint Strategic Planning Unit (JSPU) the process for carrying out future work on minerals and waste planning is currently under review.
The adopted policies of the South East Plan remain part of the Development Plan until the document is formally revoked by the provisions of the Localism Bill. Those South East Plan policies relating to minerals and waste planning therefore remain relevant to the consideration of planning applications for minerals and waste development.
