Deprivation of Liberty Safeguards
The Deprivation of Liberty Safeguards (DOLS) comes into force on 1st April 2009. The safeguards provide a legal framework for Local Authorities and Primary Care Trusts to authorise the deprivation of a person’s liberty if it is deemed to be in their best interests – e.g. to protect them from harm.
The safeguards will only be applicable to those adults who lack capacity to decide about their care and treatment and who are resident in either a care home or a hospital.
The Safeguards will not be applicable to Adults detained under the Mental Health Act 1983 as there are safeguards already in place for this vulnerable group.
