Noise nuisances

What the council can investigate

The Environmental and Communities Team investigate complaints of noise nuisance from:

  • domestic premises
  • commercial premises
  • vehicle alarms
  • mechanical equipment in the street

We cannot deal with noise from:

  • traffic
  • aircraft
  • antisocial behaviour in the street - contact the police on the ‘101’ non-emergency number

What the council can do

We will inform the person responsible for the nuisance that a complaint has been made and provide advice on how to avoid further problems. You will be asked to submit a diary of events if the problem persists.

If we receive evidence that the reported problems constitute a statutory nuisance, we are required to serve an abatement notice on those responsible under the Environmental Protection Act 1990. An abatement notice requires that any nuisance must be prohibited, and must not take place in future.

Failure to comply with an abatement notice is a criminal offence. It can result in a prosecution via a magistrates' court, with a fine of up to £5,000 imposed on those responsible.

What you can do

If your neighbour is making the noise, we recommend you try to speak to them about the noise problem. They may not realise they are bothering anyone.

If you do not feel confident talking to them, you could send a letter explaining how the noise is affecting you. Keep to the facts and don’t get too emotional. Try to understand it from their perspective as well as your own.

If this does not resolve the issue, complete the report a noise nuisance form.

You will also need to start collecting your evidence to support the complaint:

  • download the 'The noise app' (available for Apple and Android devices) - please see the noise app user guide
  • start to complete your noise nuisance diary sheet
