There is specific legislation that applies to HMOs irrespective of whether they require a HMO licence to operate. These regulations give responsibilities to managers of HMOs as well as occupiers and require certain standards of accommodation to be met as well as a decent standard of management.
You must make sure that:
- the house is suitable for the number of occupants (for example in size and facilities)
- if the HMO is licensed, the manager of the house - you or an agent - is considered to be ‘fit and proper’, for example no criminal record, or breach of landlord laws or code of practice
You must also:
- obtain a landlord's gas safety certificate every year
- install and maintain smoke alarms and a proper means of escape in case of fire
- provide safety certificates for all electrical appliances when requested
If the HMO requires a licence, there may be other conditions to your licence, for example improving the standard of your facilities. We will let you know when you apply.
