Planning Obligations Supplementary Planning Documents

The Planning Obligations Supplementary Planning document (SPD), February 2015, sets out the council’s approach to securing infrastructure by planning obligations and explains the relationship with the Community Infrastructure Levy (CIL).

CIL came into effect in the borough on 6 April 2015. Planning obligations for infrastructure will continue to be sought by the council, although this will be scaled back.

Site-specific planning obligations will be sought where infrastructure:

  • does not appear on the CIL Reg 123 list
  • does not conflict with the CIL Regulation 123 pooling restriction, that limits the pooling of Section 106 payments to no more than five planning obligations; and
  • fulfils the planning obligation tests set out in CIL Regulation 122

Developments that have an impact on the Thames Basin Heaths Special Protection Area (SPA) will be required to provide mitigation. This includes provision for Suitable Alternative Natural Greenspace (SANG) and Strategic Access Management and Monitoring (SAMM), which will be secured by planning obligation. Model Section 106 Agreement

The council has developed a standard Section 106 Agreement for SPA impact mitigation.
