What happens next

All responses to the consultation will be considered to inform the final version of the SPD.

Once the final version of the SPD is adopted, it will be a material consideration when determining planning applications.

The draft SPD

The document will provide updated detailed guidance on how to comply with policies in the Local Plan.  It primarily provides guidance in relation to the implementation of the following Bracknell Forest Local Plan to 2037 (PDF, 121 MB) policies:

  • LP 24 Infrastructure
  • LP 25 Transport principles
  • LP 26 Transport infrastructure principles
  • LP 27 Climate Change
  • LP 30 Green Infrastructure
  • LP 44 Protection of community facilities and services
  • LP 45 Play, open space and sports provision
  • LP 46 Standards for Open Space of Public Value
  • LP 57 Sustainable Drainage Systems (SuDS)
  • LP 60 Assessing Transport Impacts and Requirements
  • LP 61 Travel Plans

The main changes in the Draft SPD subject of this report from the existing Planning Obligations SPD (2015) are summarised as:

  • relating to more up-to-date policies in the Bracknell Forest Local Plan 2024 rather than the superseded Bracknell Forest Borough local Plan (2002) and the Core Strategy Development Plan Document (2008)
  • removing out of date and repetitive references such as the Community Infrastructure Levy (CIL) s106 pooling restrictions.
  • simplifying the overall document
  • providing updates and introduces costs for open space and community facilities
  • updating the costs for education provision
  • updating and clarifying transport provisions
  • amending the use classes for travel plans’ updates costs and introduces alternative travel plan costs
  • clarifying what other obligations can be sought
  • removing waste and recycling as a topic area because the service no longer require recycling points to be secured by s106 planning obligations
  • removing references to neighbourhood centres as they are not relevant or secured by s106 planning obligations

Planning Obligations 2015

The Planning Obligations Supplementary Planning Document (SPD), February 2015, sets out the council’s approach to securing infrastructure by planning obligations. It explains the relationship with the Community Infrastructure Levy (CIL).

CIL came into effect in the borough on 6 April 2015. Planning obligations for infrastructure will continue to be sought by the council, although this will be scaled back.

Site-specific planning obligations will be sought where infrastructure fulfils the planning obligation tests set out in CIL Regulation 122.

Developments that have an impact on the Thames Basin Heaths Special Protection Area (SPA) will be required to provide mitigation. This includes provision for Suitable Alternative Natural Greenspace (SANG) and Strategic Access Management and Monitoring (SAMM), which will be secured by planning obligation. 

Guidance can be found in the Thames Basin Heaths SPD (April 2025). This guidance supersedes Section 5.12 and Appendix 1 Section 5 of the Planning Obligations SPD below.

Guidance related to affordable housing can be found in the adopted Housing SPD (March 2025). The Housing SPD supersedes section 5.8 of the Planning Obligations SPD.
