Reason for removal
This tree has been identified as the cause or a significant contributing factor in subsidence damage to 5 Frobisher.
This constitutes a legal nuisance which, unless appropriate action is taken, will result in the council liable to pay considerable damages that far exceed the value of the trees.
We have considered other solutions, including:
- pruning
- root barriers
- underpinning
However, on balance, these solutions are not reasonably practical or affordable in this case.
Proposed replacement planting
Our proposed replacement tree includes:
- 1 Field Maple, located in the verge, situated in the largest portion of greenspace
A field maple tree is suitable for planting in smaller areas, such as soft landscaping in streets. It will also help increase the diversity of tree species in the local area.

Resident feedback:
The silver birch is sited too close to the boundary wall.
There is (sic) several silver birch trees in the vicinity so the tree has no special value.
Happy with replacing silver birch with field maple.

Disputes removal of the tree. Suggests remedial work to the tree, following consultation with their tree surgeon. Flags instability of the affected adjacent garden wall, and the potential impact the work might have on this.
Our response:
We appreciate the resident’s commitment to preserving the silver birch.
We have explored alternatives, such as pruning, root barriers, and underpinning. However, we have determined that these options would either fail to resolve the issue or cause severe harm to the tree, thereby further exasperating the problem.
Removal is the only practical solution to prevent further structural damage. Care will be taken during tree removal to avoid destabilising the wall.
To maintain canopy cover and species diversity, we will plant a field maple in a more suitable location, reducing the risk of future problems.

To proceed with the proposed work outlined above.
